SUMMARY

A citizen asked the Ministry of Public Works of the Community Council of Castilla-La Mancha for information on the execution of works on a roundabout of a CM-101 road, in the town of Fontanar (Guadalajara).

After the deadline to resolve without obtaining a response, the interested party presents a complaint to the Council of Transparency and Good Governance in October 2020.

The Council of Transparency dismisses the claim since the claimant is the mayor of the locality affected by the work and considers that the request for information that gives rise to the claim is formulated as a representative public office, within the necessary bilateral relations between a municipal administration and the regional administration and not according to the provisions of the law. In front of the resolution issued by the Council, the City of Fontanar interposes contentious-administrative appeal that has entry into the Council on April 15, 2020.
