SUMMARY

A citizen asked the Department of Sustainable Development of the Community Council of Castilla la Mancha for the documents that made up the administrative file for the recovery of the aid received by a telecommunications company.

Not satisfied with the response given by the administration, the claimant filed a complaint with the Transparency and Good Governance Council (CTBG) in November 2020.

The CTBG dismisses the claim because it considers that, in the case of providing the requested information, the limits of subparagraphs h), economic and commercial interests and k), guarantee of confidentiality or secrecy required in decision-making processes, of article 14.1 of Law 19/2013, of December 9, on transparency, access to public information and good governance.

Faced with the resolution issued by the CTBG, the interested party lodges a contentious-administrative appeal that has entry into the Council on June 4, 2021.
