A citizen asked the Department of Social Services and Public Governance of La Rioja for information about the number of minors under the guardianship of the administration who during the guardianship had been subject to police or judicial investigation as possible victims of any type of crime against sexual freedom and compensation.
Dissatisfied with the decision of the administration, which provided some of the information requested but which considered that giving it in its entirety implied carrying out a previous action of reprocessing (18.1.c) of the LTAIBG), in February 2022 the citizen presents a complaint to the Council of Transparency and Good Governance (CTBG).
The CTBG estimates the claim since it is public information according to Law 19/2013, of December 9, on transparency, access to public information and good governance (LTAIBG), and does not consider any legal limit or any cause of inadmissibility to apply.
In response to the resolution issued by the CTBG, the regional administration lodged an administrative appeal, which entered the Council on April 17, 2023.
