A legal person requests different information about different technical municipal reports of the municipal architect of the City of Petra. The Administration does not respond to the request. The failure of the administration to comply with the legal obligation to issue an express resolution on the request for access within the legal deadline, as well as the lack of response to the request for claims of this Council, cannot render ineffective the exercise of a right of constitutional rank, such as the right of access to public information.
The Council considers the claim, given that the request is considered to be public information, that the claimed administration has not adequately and sufficiently justified the occurrence of any cause of inadmissibility of Article 18 of the LTAIBG, nor the application of any of the limits provided in Articles 14 and 15 of the LTAIBG.
Faced with the resolution issued by the CTBG, the local entity lodges a contentious-administrative appeal that has entry into the Council on June 23, 2025.
