On August 15, 2024, the Official State Gazette (BOE) published the extension of the agreement signed between the Council of Transparency and Good Governance and the Autonomous City of Ceuta to attribute to the latter the exercise of jurisdiction for the resolution of the claims provided for in article 24 of Law 19/2013, of 9 December, on Transparency, Access to Public Information (LTAIBG).
This competence covers the claims that are presented against the resolutions issued by the Administration of the Autonomous City of Ceuta, as well as the public sector entities linked or dependent on it, with respect to the requests for the right of access to public information raised by the citizens against them. The first agreement in this matter between the CTBG and Ceuta was signed in 2016.
The fourth additional provision of the LTAIBG establishes that the resolution of the claim provided for in its article 24 shall be the responsibility of the independent body determined by the autonomous communities in the cases of resolutions issued by the administrations and the public sector of the latter, and by the local entities within their territorial scope. It provides for the possibility of the autonomous communities attributing to the Council of Transparency and Good Government the competence for the resolution of these claims, through the conclusion of the corresponding agreement.
Currently, there are seven autonomous communities and cities whose complaints regarding access to public information are heard by this Council: Asturias, Illes Balears, Cantabria, Ceuta, Extremadura, La Rioja and Melilla.
In this regard, it should be recalled that the Council also processed the claims corresponding to the Community of Castilla-La Mancha and the other administrations and entities of that territory submitted until November 2023, when the Regional Transparency Council of Castilla-La Mancha began to operate.
In 2023, the Council of Transparency and Good Governance resolved a total of 1,090 claims at regional and local level, which was 66.4% more than the previous year.
