In the first nine months of 2024, the activity of the Council for Transparency and Good Governance (CTBG) in its function of processing the complaints submitted by citizens in search of protection of their right of access to public information has increased considerably in relation to the General Administration of the State and the public sector.

Thus, the Council has resolved between January and September a total of 1,122 claims at the state level, which implies an increase of 37.7% in the number of resolutions issued compared to the same period of the previous year.

Of the 1,122 claims resolved, only 5.1% were inadmissible and 6.5% were filed due to the withdrawal of the person concerned.

Estimated 6 out of 10 statewide claims

With regard to the meaning of the resolutions of the claims admitted to the proceedings, six out of ten (688 claims, 61.3%) were estimated totally, partially or for formal reasons.

A total of 299 complaints (26.6 per cent) were dismissed on any of the grounds provided for in the Act and 5 were suspended (0.4 per cent), as judicial proceedings were pending in a claim of identical characteristics.

Of the estimated 688 claims, just over half (53.9 per cent) were fully estimated, i.e. the Council urged the requested body or agency to provide all the information requested by the claimant. 12.7% of the complaints were partially estimated, the Council resolving that the Administration should submit part of the information requested by the interested party, and the remaining third (33.4%) was estimated for formal reasons, since the Administration had delivered the information requested once the complaint was submitted to the Transparency Council, which means that the right of the applicant to receive the information was violated within the legal period established by the Transparency Law.

It is noteworthy that 39.3% of the complaints had been submitted to the Council for administrative silence, that is, for alleged dismissal due to the failure of the State body or agency to respond in due time to the request for information submitted by the citizen.

Increases the number of statewide claims filed by 20%

In the first nine months of the year, it has not only increased the number of statewide claims resolved by the Council. There has also been a significant increase in the number of complaints received by the institution: between January and September, a total of 1,038 complaints were filed with the General Administration of the State and its public sector bodies. This represents 20.1% more statewide claims received than in the same period of the previous year, when 864 were filed.
