RCA200. Centre for Scientific Research (CSIC). Identification of the delineants of the organism
SUMMARY
The Professional College of Delineants of Madrid submitted a request for access to the Ministry of Science and Innovation to obtain information on the identification of the delineants of the CSIC that exercise this profession within the Community of Madrid.
The Administration denied access on the grounds that the professionals involved in the CSIC work far exceed the territorial scope of the Professional Association, and therefore the provisions mentioned in the transparency law do not apply to them.
When a complaint was filed, the Council of Transparency and Good Governance partially considered it, since the right of access to information regulated in the transparency law can be exercised, in the words of its art. 12, by all persons without the provision of collaboration between Administrations undermining the possibility of exercising the right of access to information held by a subject. We can understand that it is intended with the request for information to know the professionals who provide services in the CSIC and, specifically, in one of its centers located in Madrid and, with this data and the information available to the Professional College of Delineants itself as an applicant, to know if this requirement of collegiation is met.
The information on the name and surnames of professionals who provide their services in the CSIC in the centers located in the Community of Madrid can be provided under the right of access recognized in the law, except the specific data of the DNI of the professionals, protected by the regulations of protection of personal data.
