In exercise of the right of access to public information, the Ministry for Digital Transformation and the Civil Service was requested to have access to an administrative file relating to a complaint against an official. The Ministry did not respond within the legally established deadline, so the request was deemed rejected by silence.
During the conduct of the complaints procedure, the competent body states that the submission was not processed as a request for access to information, but that, in any event, the requests had received a response in two previous offices notified to the complainant in 2023. It is also reported that no disciplinary proceedings have been initiated against the official of the City of Piera, «no subsequent administrative action or additional documentation has taken place since May 2023’.
The Council dismisses the complaint, pointing out that, from what the Ministry said in the processing of allegations, it follows that the information was provided, not corresponding to ‘to this Council to give its opinion on the appropriateness or appropriateness of the conclusions of the competent body with regard to the nature of the decision not to open the file and the possible remedies».
