One citizen asked RTVE for information on the cost of Spain’s participation in the Eurovision Song Contest 2015, with details of each cost. RTVE did not provide any response to that request and on July 10, 2015 the same citizen filed a complaint with the Council of Transparency and Good Governance.
In its claims, RTVE considers that disseminating the requested information would be detrimental to its economic and commercial interests, since the entity competes in the audiovisual market and its competitors would have access to strategic information and even internal criteria for the elaboration of the information.
The Transparency Council, on the other hand, considers in its resolution that the information does not harm the commercial or business secrecy or the economic and commercial interests of RTVE, and considers that knowing the expenditure destined for the participation of public television in an international event financed with public funds responds to the spirit and purpose with which the Law on Transparency, Access to Information and Good Governance was approved. For all these reasons, RTVE was urged to provide the requested information within 15 days.
State: Final judgment. The Supreme Court has dismissed the RTVE Corporation’s cassation appeal. It is thus confirmed that the information will have to be provided, as established by the Resolution of the Council of Transparency and Good Government and confirmed the judgments of the Administrative Central Court No. 6 of Madrid and the judgment on appeal of the National High Court.
