Appeal of an individual by resolution concerning the preparation of the Royal Decree on Self-Consumption
ABSTRACT
A citizen asked the Ministry of Industry, Energy and Tourism for information on the meetings held on the occasion of the drafting of Royal Decree 900/2015, of 9 October, which regulates the administrative, technical and economic conditions of the modalities of self-consumption electricity supply and self-consumption production, including identification of attendees, minutes and documents received by third parties.
The request was denied on the understanding that part of what was requested was internal information and that in order to respond to the rest of the request, a prior reprocessing activity was necessary. When a complaint was filed with the Council, the Council decided on the basis of the right to know the internal meetings and, where appropriate, with third parties, of which there was evidence and, with regard to the reports or documents of third parties, it was considered that access should be given to the allegations made in the hearing procedures carried out during the processing.
The applicant, on the understanding that the resolution of the Council of Transparency and Good Governance did not fully cover the request made, filed an administrative appeal.
State: There is already a Madrid Administrative Court No. 7 ruling in favour of the Transparency and Good Governance Council resolution and an appeal ruling confirming the previous one.
