SUMMARY

An individual submitted a request for access to information addressed to the Ministry of Finance and Public Administrations, which was intended to know the latest public audit of RTVE carried out by the General Intervention of the Administration.

The same individual filed a complaint with the Council of Transparency and Good Governance when his request was partially denied because, in the opinion of the Corporation, there is no legal obligation to make such accounts public.

The Board considered the complaint when it considered that the Audit Reports should be published, in application of the principles of active publicity of the transparency law. In the first instance, Central Administrative Court No. 4 has proved the Council to be right.

The ruling is not yet final as the RTVE Corporation can go to the Supreme Court in cassation. Both the judgment of the Madrid Central Administrative Court No. 4 and the judgment on appeal before the National High Court confirm the resolution of the Council of Transparency and Good Governance, in which the Corporation is urged to provide the information.
