SUMMARY

The Staff Board of the AEAT presented a request for access to information addressed to the State Tax Administration Agency, which aimed to know the objectives assigned and the distribution of productivity in the years 2015 and 2016 in the Delegation of Valencia.

The Agency replied to the request for access stating that for staff representatives there was a specific access regime to information, which is why Law 19/2013, of 9 December, on transparency, access to public information and good governance is not applicable. The Personnel Board filed a complaint with the Council of Transparency and Good Governance (CTBG) requesting the delivery of the information. Once the complaints procedure had been opened, the Agency ratified its previous conclusions.

The CTBG considered the submitted Claim and considered that there is no such specific access regime to the information, as agreed in a previous Resolution with the same content. However, it has been appealed to the courts of justice, so the execution of this Resolution is subject to prior judicial pronouncement on the previous matter.
