Appeal of the Port Authority of the Balearic Islands against granting access to documentation of a file on admission of tenders for contracting works
ABSTRACT
A citizen submitted a request for access to the information addressed to the Port Authority of the Balearic Islands to know the minutes of the Board of Directors and the Report of the State Attorney on the admission or not of an offer in the competition file of projects for the reform of the Sports Dock of the Club Náutico de Ibiza.
The Port Authority of the Balearic Islands denied access to the documentation, considering that it is confidential.
When a complaint was filed, the Transparency and Good Government Council considered it, since it is not appreciated that this confidentiality of the records exists. Nor does it affect the professional secrecy of the State Attorney, by not disclosing the confidentiality of any natural person and becoming involved in what is his consultative function.
