Resources of different Ministries against the granting of expenses for institutional advertising in the Media Plan
A citizen submitted several requests for access to information directed by different ministries and aimed to know the list of campaigns carried out and budget executed of each of the ministries and their dependent agencies for the years 2012, 2013, 2014 and 2015, broken down by means of the media where the campaign was announced.
The Ministries denied access to information and the same citizen filed a complaint with the Council of Transparency and Good Governance. During the proceedings, several Ministries alleged that they had to carry out prior reprocessing to provide the requested data, the cause of inadmissibility set out in article 18.1 (c) of the Act being applicable. They also said that the economic and commercial interests of third parties could be harmed.
The Transparency Council considered the complaints submitted and considered in its resolutions that there is no reprocessing of the information and that it does not harm the economic and commercial interests of the contracting companies, since it is information that must be made public ex officio, by mandate of article 8.1 (a) of the transparency law.
The various ministries, because they do not agree with the resolution of the Council for Transparency and Good Governance, file a judicial appeal before the contentious-administrative jurisdiction.
