ABSTRACT

A Union submitted a request for access to the information addressed to the Ministry to access the full content of a file, with all its actions, documents and final resolution sent to the INE Delegated Intervention.

The Ministry refused access, on the understanding that the applicant did not have the status of interested party.

When the complaint was filed, the Council for Transparency and Good Governance considered it, since, citing the doctrine of the Constitutional Court, trade union representatives represent the interests of public employees, including respect for the legal principles of the Basic Statute of the Public Employee. Likewise, the limit relating to the investigation and prevention of administrative or disciplinary offences does not apply.
