A citizen submitted a request for access to information addressed to the Ministry of Foreign Affairs and Cooperation to access a file containing a Legal Report with the opinion of the Ministry on a dispute brought before an Italian Court.

The Ministry denied access on the grounds that such information violated the equality of the parties in judicial proceedings and effective judicial protection.

When a complaint was filed, the Council for Transparency and Good Governance partially considered it, since this report is accessible as part of the judicial procedure in which it falls, so we must conclude that the claimant already has this information. Therefore, the office of commission of the report must be provided to the Legal Service, which is part of the file.
