SUMMARY

A citizen submitted a request for access to information addressed to the Ministry of Justice to access information on the assets recovered by the Office of Asset Recovery and Management since 2015.

The Ministry denied access, on the understanding that such information affected the protection of personal data and the investigation of criminal or administrative offences.

When a complaint was filed, the Transparency and Good Governance Council considered it in part, since the request concerns the protection of data of natural persons under investigation (not companies) but does not presuppose harm to the investigation of criminal or administrative offences, since the Administration does not sufficiently justify it.
