A union filed a request for access to the information addressed to the Tax Agency to access the list of jobs of the AEAT’s workforce, the nominal list of workers and the salary mass for the period 2015-2016.
The administration denied the information, claiming that the First Additional Provision, paragraph 2, of the transparency law is applicable, since there is specific access legislation, such as the tax regulations.
When the complaint was filed, the Council of Transparency and Good Governance partially considered it, considering that the Additional Provision does not apply, since the tax legislation does not provide a true procedure for access to public information and that the administration has given part of the information in the way of a complaint.
The applicant for the information filed a contentious-administrative appeal.
