SUMMARY

A citizen submitted a request for access to information addressed to the Spanish Agency for Medicines and Health Products (AEMPS) to know the state of maintenance in the market of the product 2LC1, from Laboratorios Labo Life and its relevant authorization to refuse use. He was also interested in its advertising as a cancer treatment.

The AEMPS denied the information because it is protected by the duty of confidentiality and affects the protection of personal data.

When the complaint was filed, the Council of Transparency and Good Governance considered it in part, considering that there is confidentiality only in certain aspects, not including the date of application for authorization. There is an undeniable public interest in the fight against cancer. It is also understood that it does not affect personal data.
