118. Ministry of Development. Audits of inspection of works and services
SUMMARY
A journalist submitted a request for access to the Ministry of Public Works to learn about the procedural audits prepared by the General Subdirectorate of Services and Works during the year 2017.
The Administration denied the information on the grounds that the request affected its inspection and control functions and was ancillary or supportive.
When the complaint was filed, the Council for Transparency and Good Government considered it, considering that the arguments of the Administration were not applied, since it is not auxiliary information even if it is prepared by internal bodies of the Ministry and since its public knowledge serves to respond to the citizens, as established by the Law. Likewise, when the audits are completed, they do not affect their development and final conclusion. However, it is appreciated that there is information that can reveal fixed working methods that could harm the development of future audits, compromising their results, so they must be eliminated from the information provided.
