126. Access to the proceedings of the Spanish Opera House in Italy
SUMMARY
A citizen submitted a request for access to information, addressed to the Ministry of Foreign Affairs, European Union and Cooperation, to know the minutes of the meetings of the governing board of the Spanish establishments in Italy, forwarded by Obra Pía.
The Ministry replied to the request on the grounds that the information should be requested from Obra Pía itself, since it does not fall within the Spanish public sector, although it enjoys diplomatic protection.
When the complaint was filed, the Council of Transparency and Good Government considered it, since the presidency, legal representation and direction of the Obra Pía is in charge of the Spanish Ambassador to the Holy See, its board is composed of two other Spanish diplomats and their agreements are forwarded to the Ministry, which has the requested information, that is, minutes of collegiate bodies, which have to be disclosed for their public interest, as has been done in previous cases.
