SUMMARY

A citizen submitted a request for access to information, addressed to the RTVE Corporation to access the contracts between RTVE and the entity Video Mercury Films, worth 800,000 euros.

RTVE denied the request for affecting the protection of personal data and their economic and commercial interests. He also argued that he could not give the information because he had to rework it.

When a complaint was filed, the Transparency and Good Governance Council considered it in part, since data protection does not apply, since the publication of public sector contracts is mandatory, and can also be done anonymously, as requested by the claimant. Nor does it affect the economic and commercial interests of RTVE, which is basically funded by public funds, or of the awarding company, whose trade secrets are equally safeguarded. And finally, if the anonymized contracts are given, it is not necessary to rework the information.
