135. Communications with the Holy See on the exhumation of Francisco Franco
SUMMARY
A citizen submitted a request for access to information, addressed to the Ministry of the Presidency, Relations with the Courts and Equality, to obtain a copy of the letter from the Vice-President of the Government and Minister of the Presidency, Relations with the Courts and Equality, addressed to the Secretary of State of the Holy See, which deals with various aspects of the exhumation of Francisco Franco, including the position of the Prior of the Abbey of the Valley of the Fallen and the response to it.
The Ministry did not provide information on the grounds that it could jeopardize external relations with the Holy See.
When a complaint was filed, the Council for Transparency and Good Governance considered it, since there is no confidentiality of the requested documentation, which has been previously made public by the Government in statements and that this documentation has an undoubted public interest that reduces the limit invoked.
