144. Denial of access to medicines from hospital pharmaceutical expenditure
SUMMARY
A citizen submitted a request for access to information, addressed to the Ministry of Health, Consumption and Social Welfare, to have access to information. Breakdown of the medicines that make up hospital pharmaceutical expenditure in 2018, by Autonomous Community and other public administrations.
The Administration denied the request because it is confidential data that affects the interests of the companies.
When a complaint was filed, the Council for Transparency and Good Governance considered it since the damages indicated are not appreciated, since the Administration simply invokes them, which does not respect the criteria indicated in this regard by the courts of justice, which require rigor and proportionality in the application of legal limits.
