A private foundation submitted a request for access to the information addressed to the Ministry of Finance to obtain the data related to the remuneration of all temporary staff of the Ministry during the year 2018.
The Administration partially granted the information relating to the remuneration of the personnel making the decisions but denying that of the possible personnel of low levels, as it would affect their right to the protection of personal data.
When the complaint was filed, the Council of Transparency and Good Governance considered it in part, arguing that information should be provided on remuneration of contingent personnel (whether or not they are career officials) when they are in an advisory position and special trust. When the identification of public employees and the remuneration they receive is requested, the Council understands that the response should include not only staff at level 30, but also those at all levels below that level, up to and including level 28, with the identification of the persons occupying those positions. Likewise, and when the request refers to contingent personnel, the response must also refer to the career officials who are in such a situation.
