RCA171. RTVE. Contract of the program "From Today" (Summer Days)
SUMMARY
A citizen submitted a request for access to information to the RTVE Corporation to obtain a Copy of the program contract: "From today" (Summer Days).
RTVE denied access on the grounds that it affected the protection of the personal data of the parties to the contract and the economic and commercial interests of RTVE. He also argued that it could affect professional secrecy and industrial and intellectual property.
When a complaint was filed, the Council of Transparency and Good Governance considered it, since there are multiple precedents that support the delivery of public contracts, an obligation contemplated in the Article 8.1.a) of the Transparency Act. On the other hand, the identification of natural persons who represent legal persons is also not covered by the personal data protection regulations. To know the content of public contracts entails, in the opinion of the Council, the purpose of the Law. It does not affect the economic and commercial interests of the RTVE Corporation to provide information that involves using public funds, so the interest in disclosing the information is superior to the private interest of RTVE. Nor are there any commercial secrets worthy of protection or any effect on industrial and intellectual property.
