SUMMARY

A citizen submitted an application for access to the State Public Employment Service of the Ministry of Labour and Social Economy to obtain access to the general instructions on benefits and the criteria for recognition of their own benefits, including the 2014 benefit.

The Administration granted partial access, denying the request of the criteria of recognition of the benefit of the interested party, in accordance with paragraph 1 of the first additional provision, of Law 19/2013, of 9 December.

The Council of Transparency and Good Governance dismissed the complaint on the grounds that, beyond the disputes of a particular nature in which the complainant is involved with the disputed Administration, we consider that the LTAIBG aims to guarantee the general interest in the knowledge and control of the agencies subject to the complaint through accountability for their actions. This objective, in the opinion of the Transparency Council, is achieved by the response obtained. In addition, the claimant has at its disposal the means of redress applicable to the proceedings in which it is interested, whose continuity we cannot discard if we take into account the deadlines for the filing and resolution of administrative and judicial remedies, which would be applicable.
