A citizen submitted a request for information to the GEOLOGICAL AND MINING INSTITUTE OF SPAIN (CSIC), of the MINISTRY OF SCIENCE AND INNOVATION, requesting access to the data of analytical samples carried out in execution of the "Mercury Project Phase I and Phase II" at the Son Reus landfill
The Administration denied access on the grounds that the request for information between public administrations is governed by Law 40/20/S, of 1 October, on the Legal Regime of the Public Sector, not by the LTAIBG.
The Council of Transparency and Good Governance rejected the complaint, on the grounds that the information requested is “a support and support” to prepare the report “Impact Study”. that over groundwater may cause the San Reus landfill” that was handed over to the claimant.
