In exercise of the right of access to public information, the MINISTRY OF HEALTH was requested to provide access to information regarding pharmaceutical companies that have been purchased vaccines against the coronavirus, their cost and the quantity of doses acquired.
The requested Ministry issues a resolution in which it agrees to grant partial access to the requested information. The refusal of a part of what is requested is made by the application of the limits of access to information under the causes provided in Article 14.1 h), j) and k) of LTAIBG, since it is alleged to harm economic and commercial interests, professional secrecy and the guarantee of confidentiality in the decision-making processes.
The Council does not accept the claim for extemporánea, noting that the deadline provided in Article 20.1 LTAIBG has been missed. The resolution of the Ministry is notified on December 23, 2024, with the claimant having had access to it on the same day, so the deadline for filing the claim was January 23, 2025. The claim is filed in the electronic registry of this Board on January 24, 2025.
