Appeal filed by Navantia against Council resolution estimating the right to know the remuneration of the directors of the entity
The request for information submitted to Navantia The objective was to know the individualized remuneration of the members of the Navantia Management Committee, the compensation received by a former manager and the System of Professional Classification of the non-managerial personnel of free appointment and not included in the collective agreements of Navantia. The request was denied on the understanding, in the first two types of information, that the interested parties had not given their consent to provide the personal information that affected them (although the remuneration was provided but not individualized) and, in the third case, that access would harm the equality of the parties in judicial processes and, in addition, that the law regulating social jurisdiction was of preferential application.
In its resolution, the Council of Transparency and Good Governance applied its interpretative criterion approved jointly with the Spanish Data Protection Agency regarding access to salaries of management personnel as well as precedents that had been resolved by the Council to consider that the remuneration information should be given on an individualized basis. With regard to the knowledge of the compensation received by a former manager, the Council recalled the obligation to make this information public in application of art. 8.1 (f) The Transparency Act. Finally, it was not considered that the information on the system of professional classification could affect the equality of the parties in judicial proceedings that, in any case, did not exist at the time of the request.
