148. Refusal of access to information relating to the recognition of research sexes
SUMMARY
A citizen submitted a request for access to information addressed to the Ministry of Science, Innovation and Universities to have access to the identifying and professional data of those university professors who had recognized research sexenniums.
The Ministry denied the request because it affects the right to the protection of personal data.
When a complaint was filed, the Council of Transparency and Good Governance considered it because, having made the weighting required by law between the right to data protection and the right of access to information, the latter must prevail, since the Organic Law of Universities allows the publication of research results without the consent of university staff. This fulfills the purpose of the LTAIBG.
