SUMMARY

The representative of a commercial entity sent a request for access to information to the City Council of Arroyomolinos (Madrid) in order to know information on the files on the restoration of urban legality initiated, and where appropriate sanctioning files initiated, as a result of the urban complaints made by that entity.

The Council of Transparency and Good Government, taking into account the generic nature of the request and that these were sanctioning files, agreed to retract the proceedings so that, in accordance with the provisions of article 19.2 of the transparency law, the City of Arroyomolinos would transfer the request to the commercial in order to identify sufficiently the information requested in accordance with the provisions of the law.

By judgment of the Central Administrative Court No. 9 of Madrid, of October 26, 2017, the appeal filed was dismissed confirming the resolution of the Council of Transparency and Good Governance.

Dissatisfied with this ruling, the mercantile filed an appeal that was dismissed by judgment of the seventh section of the Administrative Litigation Chamber of the National High Court of February 12, 2018.
