14. Information relating to public and mixed car parks in the city of Madrid
SUMMARY
Application for the right of access addressed to the City of Madrid, in order to know certain information about the influx of vehicles, occupancy rates and collection of public parking and mixed car parks of the city of Madrid in the years 2015, 2016 and 2017.
The Madrid City Council estimated the request raised, although it determined that the information should be provided by the concessionary companies of the management of the car parks. One of these companies provided the information although it expressed its opposition to the disclosure of part of it, which is why it filed a claim with the Council for considering the application of the limit regulated in article 14.1 h) of Law 19/2013, of 9 December, on transparency, access to public information and good governance, referring to economic and commercial interests.
The Council of Transparency and Good Governance dismissed the complaint because it considered that the public interest in knowing the management of a public service by concessionaire companies prevailed over the economic and commercial interests of the latter.
Faced with this resolution, the complaining party filed an administrative appeal in December 2018.
