SUMMARY

A citizen sent a request for access to information to the Polytechnic University of Madrid (UPM) by virtue of which he requested a copy of a specific Doctoral Thesis. In the absence of a response to his request from the university, the interested party filed a complaint with the Council of Transparency and Good Governance.

At the time of processing the claim, the Council granted a hearing to the author of the thesis, in order to ensure his rights and interests. The author of the thesis did not make any allegation within the time granted.

In view of the absence of arguments on the part of the author of the thesis and because the Council considers that the object of the claim - a doctoral thesis - is configured as public information for the purposes of Law 19/2013, of 9 December, as it is a document held by a subject for whom it is obliged, the claim was estimated and the UPM was urged to provide a copy of the requested thesis to the claimant.

Dissatisfied with the resolution issued, the UPM lodges an administrative appeal.

The judgment in the first instance considers the appeal of the UPM and the judgment on appeal ratifies the previous one. The Council of Transparency and Good Governance is assessing whether to go to the Supreme Court on the way of cassation.
