29. Information regarding applications for validation of master's degrees at the Rey Juan Carlos University.
SUMMARY
A citizen sends an application for access to public information to the Rey Juan Carlos University (URJC) by virtue of which he is interested in the applications of students for the validation of credits in a master’s degree, both official and own degrees, received by the URJC from the 2007-08 academic year until the 2017-18 academic year. By not receiving a response to his request from the URJC, the interested party presents a complaint to the Council of Transparency and Good Governance (CTBG).
In the processing of claims, the URJC argues that the information should not be made available to the interested party due to the existence of personal data and the need for a prior reprocessing action.
According to the CTBG in its resolution, both arguments cannot prosper for the following reasons: first, the protection of personal data can be saved with an anonymization of such data; second, the necessary prior action of reprocessing is not duly justified by the URJC, since although it is voluminous information its making available to the interested party does not need to perform new operations of analysis, aggregation and interpretation of the information, as the courts of justice have pointed out.
For the reasons set out above, the CTBG estimates the claim submitted.
Dissatisfied with the resolution issued by the URJC interposes contentious-administrative appeal that has entry into the Council on April 11, 2019.
