SUMMARY

An environmental association filed an application with the City of Polanco, requesting information on different municipal actions carried out within the Natural Area of Special Interest “Pozo Tremeo”.

In the absence of a response to her request, the claimant filed a complaint with the Transparency and Good Governance Council (CTBG) in July 2021.

The CTBG disallowed the claim because it considered that paragraph 2 of the First Additional Provision of Law 19/2013, of 9 December, on transparency, access to public information and good governance (LTAIBG), which establishes that those matters that have a specific legal regime for access to information will be governed by its specific regulations, and by that law on a supplementary basis, were applicable.

In response to the resolution issued by the CTBG, the Complaining Association lodged an administrative appeal, which entered the Council on September 8, 2022.
