ABSTRACT

A citizen submitted a request for access to information directed to the RTVE Corporation to know the gross annual remuneration received in 2014 and 2015 by the management of the Corporation.

RTVE did not accept the request for access to public information submitted, as it was not done through the appropriate means, that is, through an electronic identification, which guarantees the constancy of its identity. In this case, the applicant has not been correctly identified, as indicated by the Law.

The Council for Transparency and Good Governance considered the complaint since it cannot be inferred in any way from the Law that requests for information must be submitted to information units that are not identified, nor that the means of submitting a request is, according to the CRTVE, the Transparency Portal.

Likewise, it must be understood that access to the information requested has been endorsed both by the interpretative criterion approved jointly by this Transparency Council and the Spanish Agency for Data Protection and by the Courts of Justice in first instance, on appeal in the National Court and in cassation in the Supreme Court.
