ABSTRACT

A citizen submitted a request for access to information addressed to the Ministry of Energy, Tourism and Digital Agenda to access information on methodology used for the definition of the type facilities of the cogeneration area from residual energies.

The Ministry denied access on the understanding that such information was auxiliary or supportive and that it jeopardized the equality of the parties in judicial proceedings.

When a complaint was filed, the Council of Transparency and Good Governance considered it, arguing that the request is relevant to the knowledge of public action and does not presuppose harm to any procedural party, since it is not sufficiently proven.
