ABSTRACT

An individual submitted a request for access to the information addressed to the Ministry of Public Works, which aimed to know the tender conditions for the supply of 15 high-speed trains.

The same individual filed a Complaint with the Council of Transparency and Good Governance when his request was denied by the Administration, understanding that it was a confidential and restricted procedure.

The Council of Transparency and Good Governance considered the Claim and considered in its Resolution that only information that affects technical or commercial secrets or aspects declared secret in the offers by entrepreneurs can be declared restricted, but not to the rest of the information contained in the tender, which is subject to the principle of transparency.
