RCA174. Post and Telegraph, S.A. Compensation for contractual breaches in postal notifications
SUMMARY
A citizen submitted a request for access to information addressed to Correos y Telemgráficas, S.A. with the aim of knowing the compensation for postal notifications outside the time stipulated in public contracts, in addition to those badly notified formally.
Correos y Télégraphs, S.A. denied the information, considering that it was abusive, since it was not in accordance with the purpose of the transparency law.
When a complaint was filed, the Council of Transparency and Good Government considered it, given that the information requested must be considered as part of the purpose pursued by the transparency law, since it allows us to know under what criteria our institutions act and how the public funds are managed. It is also not appreciated that it affects the economic and commercial interests of Correos y Télégraphs, S.A. since it provides the service exclusively.
