RCA234. Criteria followed in the “rotational productivities” of the Territorial Administration of Justice and amounts allocated in the Ministry of Justice
A union filed a petition with the Ministry of Justice, requesting access to the criteria or reasoning followed to establish the “rotational productivities” for the Territorial Administration of Justice and the amounts allocated to each of them from the budgetary concept “Performance Incentives” established in the General State Budgets, in the years 2019, 2020 and 2021.
The Administration denied access due to administrative silence.
When the complaint was filed, the Council of Transparency and Good Government considered it, since the doctrine of the Supreme Court ruled that the regulation provided for in the Basic Statute of the Public Employee and in the Organic Law on Freedom of Association cannot be deduced from the fact that such rules provide for a system of access to public information that should be applied preferentially to the regulation of the LTAIBG.
