SUMMARY

A citizen requested, before the Ministry of Finance and Public Function of the Community of Madrid, various information (declarations of assets, interests, etc.) corresponding to the members of the Government of the Community of Madrid and the senior officials of the Administration.

Not satisfied with the response given by the administration, the claimant filed a complaint with the Transparency and Good Governance Council (CTBG) in December 2020. The administration considered that to provide the requested information there was a specific procedure, that of access to the Registry of Assets and Patrimonial Rights of Senior Officials of the Community of Madrid, which determined the non-application of Law 19/2013, of 9 December, on transparency, access to public information and good governance (LTAIBG), by virtue of its First Additional Provision.

The CTBG considers the claim because it considers that in order to access the requested data it is not necessary to access the aforementioned registry and that, consequently, the LTAIBG is fully applicable.

Faced with the resolution issued by the CTBG, the Community of Madrid lodges a contentious-administrative appeal that has entry into the Council on July 15, 2021.
