The Council publishes its Report 2025, which reflects a record in the number of complaints received, with a total of 2,767

Of them, 1,778 of the claims were directed against the State Administration and public agencies and entities at the state level, while the remaining ones 989 were presented in front of administrations, agencies and entities of the autonomous and local area of the CC. AA. which have conferred on the Council the guardianship in this matter by signing the corresponding agreement –Principality of Asturias, Cantabria, La Rioja, Illes Balears, Extremadura and the cities of Ceuta and Melilla–. The increase in complaints submitted to the Council has been very significant at the state level (27.3% more than in 2024), but even more pronounced at the regional and local level (71.7% more). This is reflected in the Memory of activities 2025 of the institution, which has been sent to the Cortes Generales and published today on the Council's website, together with a Executive Summary With its main contents.

Regarding the number of claims resolved, the CTBG resolved 2,234 claims in 2025, a figure very similar to that of 2024; of these, 1,577 were at the state level, and 657 at the regional and local levels.

At the state level 93.8% of the complaints were accepted for processing and, of these, Two-thirds (65.9 per cent) resulted in pro-claimant pronouncements in their various forms: full, partial or for formal reasons (the latter implies that the administration provided the information once the claim was filed with the Council, having violated the citizen's right to receive the information within the time period established in the Transparency Law, which represents 40.3% of the estimated claims). Similar figures should be noted for the Files of autonomous and local scope, with a percentage of admission to the procedure of 88.4% and a 72.1% of favourable pronouncements (29.3% of them for formal reasons).

The memory 2025 once again highlights that a very high percentage of complaints are still filed by administrative silence, as the claimant did not obtain a response to his request for information: in particular, 45.5% of the files resolved by the Council in 2023 at the state level had been submitted for this reason, a percentage that rises to 75.3% at the regional and local levels.

As for the bodies and entities against which complaints are lodged, the ministerial departments are again the main recipients of the statewide claims resolved in 2025. With regard to ministries, 999 complaints were filed, representing 63.3% of the total, followed by those filed with State public bodies (372 cases, 23.6%), the General Secretariat of the Presidency of the Government (68 cases, 4.3%) and State commercial companies (65, 4.1%).

At the regional and local level, the bulk of the complaints were filed against the local administration. (414 cases, 63% of cases), especially municipalities; followed by the regional administration (33%) and, by far, the provincial deputies (2.6%).

As for the Most Recurring Issues of Resolved Claims, at State level Mention should be made of those relating to the civil service (223 files), especially those relating to remuneration and productivity received by public employees, contingent personnel and the carrying out of selective procedures (access to copies of examinations and assessment reports, essentially). Access to information on contracts and public works or records (administrative procedures and documentation) has also frequently been the subject of requests for information that gave rise to the claim. At the regional and local level, The main issues of the claims have been animal welfare, institutional information, public employment, economic information and urbanism, among others.

On the other hand, following the trend of recent years, the Council stepped up its activity in 2025 to assess the fulfilment of active publicity obligations, which is the other main function attributed to the institution. As set out in the annual plan approved at the beginning of the year, an individual assessment was carried out. 393 entities, to verify whether they publish and update on their websites the relevant information to control their management to which they are bound by the Transparency Act. This represents 25.2% more entities evaluated than in 2023.

All the evaluations were carried out by Council officials and with their own resources, without outsourcing any of the processes. The general reports corresponding to the different groups of subjects evaluated, as well as the individual reports of each agency or entity, are published on the Council’s website. In its reports, the Council includes specific recommendations addressed to the evaluated entities so that they can improve compliance with their transparency obligations.

In parallel with the two essential functions that have just been outlined, that of safeguarding the right of access to public information and evaluating the obligations of active transparency, many other tasks related to the other functions entrusted to the Council were carried out. These include advising and responding to queries made, both by agencies and by individuals, on issues related to the interpretation and application of public transparency regulations. 196 formal inquiries were attended to, in addition to a myriad of informal inquiries received by various means, such as e-mail and telephone. He also participated in numerous training activities aimed at public employees.

In 2025, the active role of the Council in the creation of two new stable frameworks for institutional cooperation must be highlighted. These aim to promote the culture of transparency through cooperation and the exchange of knowledge, experiences and good practices in areas of common interest, as well as the adoption of common positions on transparency and access to public information:

• At the regional level, the Conference of Bodies Guaranteeing Transparency and the Right of Access to Public Information (COTAI), entity without legal personality of collaboration and horizontal cooperation composed of the Council and the autonomous bodies of supervision in the field of transparency, constituted in May 2025.
• At European level, the European Network for Transparency and Access to Information (European Network for Transparency and Right to Information, ENTRI), formally constituted in June 2025. This network is made up of guarantor bodies from several European states, and the Council is currently part, along with five other countries, of its Executive Committee.

In 2025 the budget of the Council was 3.38 million euros, and the team of the Council was constituted on 31 December by 30 troops, in addition to the president.
