SUMMARY

A citizen submitted a request for access to information addressed to the Ministry of Health, Social Services and Equality to know the distributions of complementary productivities paid in the Ministry to all public employees and officials, since January 2016.

The Ministry did not provide the information on the understanding that Additional Provision 1(2) of the Transparency Act applies, as there is a specific procedure for access to the information contained in the Basic Statute of the Public Employee (EBEP).

When a complaint was filed, the Transparency and Good Governance Council partially considered it, since there is no specific access procedure in the EBEP, although it is understood that providing information for all staff may violate the right to personal data protection of part of the staff.
