A natural person requests various information related to inspection actions of the years 2010, 2011, 2018 and 2019 related to a dairy company that were carried out with the objective of finding out the focus of the contamination in two outbreaks of food alerts, the one of 2011 and the one of 2019. The Administration dismisses the request because it represents a detriment to the equality of the parties in the judicial proceedings and the effective judicial protection and therefore concur with the limit established in art. 14.1.f) of the LTAIBG.
The Council considers the claim by failing to assess the concurrence of the circumstance provided for in Article 14.1.f) of the LTAIBG, given that the required documentation can in no way affect the equality of the parties and the effective judicial protection with respect to an ongoing judicial process that brings its cause for different and subsequent events, in particular of the year 2019.
In response to the decision issued by the CTBG, the company concerned lodged an administrative appeal which entered the Council on June 16, 2025.
