SUMMARY

One company submitted a request for access to information addressed to the Ministry of Economy and Enterprise to obtain a copy of the Agreement signed between the Ministry and the Bank of Spain, the Ministry of Justice, the National Securities Market Commission and the FROB, for the defense of the Kingdom of Spain in international arbitration proceedings.

The Ministry of Economy and Enterprise denied the information, arguing that it damages the equality of the parties and effective judicial protection, by containing a defense strategy.

When a complaint was filed, the Council for Transparency and Good Governance considered it because the existence of the limit invoked is not appreciated, since the document has not been prepared for the sole purpose of being presented in a specific judicial procedure.
